Regulamin III Międzynarodowego Kursu Dyrygenckiego im. Grzegorza Fitelberga Masterclass 2024

Objaśnienie terminów i skrótów
III Międzynarodowy Kurs Dyrygencki im. Grzegorza Fitelberga – odpłatny kurs dyrygencki realizowany w okresie od 1 do 5 lipca 2024 roku przez Filharmonię Śląską im. Henryka Mikołaja Góreckiego, zwany dalej Masterclass 2024.

Organizator – Filharmonia Śląska im. Henryka Mikołaja Góreckiego z siedzibą
w Polsce, w Katowicach, przy ul. Sokolskiej 2 (40-084), zwana dalej Organizatorem.

Prowadzący – dyrygent, pedagog, osoba merytoryczna przekazująca wiedzę
i doświadczenie, kształcąca umiejętności praktyczne Uczestników, zwana dalej Prowadzącym.

Konsultant – osoba merytoryczna konsultująca nagrania audio-video uczestników, zarejestrowane podczas zajęć z Prowadzącym, zwana dalej Konsultantem.

Opiekun – osoba wyznaczona przez Organizatora do udzielania informacji na temat kursu, kontaktu z Uczestnikami oraz kształtowania relacji na linii Uczestnik – Organizator, zwana dalej Opiekunem.

Aplikant – każda osoba, która złożyła swoje zgłoszenie do udziału
w III Międzynarodowym Kursie Dyrygenckim im. Grzegorza Fitelberga, zwana dalej Aplikantem.

Uczestnik – każda osoba, która została zakwalifikowana do udziału
w III Międzynarodowym Kursie Dyrygenckim im. Grzegorza Fitelberga, zwana dalej Uczestnikiem.

§ 1
Wstęp

Niniejszy Regulamin określa warunki uczestnictwa w III Międzynarodowym Kursie Dyrygenckim im. Grzegorza Fitelberga Masterclass 2024 oraz zasady rekrutacji Uczestników do Kursu.

§2
Postanowienia ogólne

1. Celem Masterclass 2024 jest profesjonalizacja młodych dyrygentów (od 18 roku życia) poprzez realizację kursu dyrygenckiego.
2. Warsztaty będą organizowane w Polsce, w siedzibie Organizatora,
tj. w Filharmonii Śląskiej im. Henryka Mikołaja Góreckiego, w terminie 1 – 5 lipca 2024 roku.
3. Kształcenie Uczestników Masterclass 2024 zostanie zrealizowane w aspekcie artystycznym i praktycznym:

• Artystyczny – każdy z Uczestników będzie miał możliwość pozyskania wiedzy i umiejętności dyrygenckich – dyrygent jako fundament merytoryki artystycznej.
• Praktyczny – każdy z Uczestników otrzyma możliwość współpracy z Orkiestrą Symfoniczną Filharmonii Śląskiej – dyrygent jako główny wykonawca działań artystycznych.

4. Uczestnictwo w Masterclass 2024 jest odpłatne, zgodnie z § 9 niniejszego regulaminu.

§ 3
Uczestnictwo czynne

1. Uczestnictwo czynne w Masterclass 2024 jest limitowane w zakresie 12 dostępnych miejsc.
2. W ramach uczestnictwa czynnego każdy z 12 zakwalifikowanych Uczestników otrzymuje:

• 6 noclegów (ze śniadaniem) w bliskiej odległości od Filharmonii Śląskiej,
• 4 dni praktycznych warsztatów z Prowadzącym i Orkiestrą Symfoniczną Filharmonii Śląskiej,
• 4 dni nagrań audio-video (rejestracja wykonanej przez Uczestnika pracy dyrygenckiej),
• 4 dni konsultacji dyrygenckich (analizę materiału zarejestrowanego podczas sesji warsztatowej),
• współpracę z Orkiestrą Symfoniczną Filharmonii Śląskiej tj. pracę z orkiestrą podczas 4 warsztatowych sesji z Prowadzącym,
• możliwość poprowadzenia fragmentu próby generalnej do koncertu dnia 05.07.2024 r.,
• możliwość wystąpienia przed publicznością i poprowadzenia Orkiestry Symfonicznej Filharmonii Śląskiej podczas fragmentu koncertu dnia 05.07.2024 r.,
• certyfikat ukończenia kursu.

3. Praca wykonywana podczas Masterclass 2024 obejmuje trzy elementy.

• Praca z Prowadzącym (element pierwszy).

Pierwszy element obejmuje sesje warsztatowe, podczas których Uczestnicy będą pracować z Orkiestrą Symfoniczną Filharmonii Śląskiej. Każda aktywizacja dyrygencka dokonana przez Prowadzącego będzie obejmować pracę na realnym materiale wykonawczym bezpośrednio z Uczestnikiem. Uczestnicy bierni będą równolegle uczyć się sztuki dyrygenckiej poprzez obserwację. Kolejność aktywizacji dyrygenckiej Uczestników będzie alfabetyczna (od a do z), a jej czas minimalny
to 20 minut każdego dnia od 1 do 5 lipca 2024 r., dla każdego czynnego Uczestnika.

• Konsultacje dyrygenckie (element drugi).
  Zajęcia obejmują analizę materiału zarejestrowanego podczas sesji warsztatowej. Mają one charakter gremialny a Konsultant będzie wskazywał obszary rozwojowe dla każdego czynnego Uczestnika. Zarejestrowany materiał zostanie także przekazany Uczestnikom czynnym kursu mistrzowskiego w formie utrwalonej wyłącznie do użytku archiwalnego (zgodnie z § 5 niniejszego regulaminu). Osoba Konsultanta nie musi być tożsama z osobą Prowadzącego.
• Finał Masterclass (element trzeci).
  Wykonanie wraz z orkiestrą symfoniczną, przed publicznością, fragmentu materiału wykonawczego, który był przedmiotem zajęć warsztatowych Masterclass 2024 (próba generalna + koncert).

4. Dodatkowo Prowadzący, na podstawie określonych przesłanek merytorycznych, wybierze jednego Uczestnika Masterclass 2024, który zostanie automatycznie zakwalifikowany do XII Międzynarodowego Konkursu Dyrygentów im. Grzegorza Fitelberga 2028. Zakwalifikowanie jednego z Uczestników do XII Międzynarodowego Konkursu Dyrygentów im. Grzegorza Fitelberga 2028 nastąpi niezależnie od wieku Uczestnika. Decyzja Prowadzącego nie będzie uzasadniana, jest ostateczna i nie przysługuje od niej środek odwoławczy.

§ 4
Uczestnictwo bierne

1. Uczestnictwo bierne w Masterclass 2024 jest limitowane w zakresie 12 dostępnych miejsc.
2. W ramach uczestnictwa biernego każdy z 12 zakwalifikowanych Uczestników otrzymuje:

• prawo biernej obserwacji współpracy dyrygenckiej Prowadzącego oraz Uczestników czynnych z Orkiestrą Symfoniczną Filharmonii Śląskiej podczas:
  1. 4 warsztatowych sesji warsztatowych z Prowadzącym,
  2. próby generalnej do koncertu z dnia 05.07.2024 r.,
  3. koncertu dnia 05.07.2024 r.;
  – certyfikat ukończenia kursu.

3. Uczestnik bierny jest zobowiązany do zorganizowania i sfinansowania noclegu we własnym zakresie.

§ 5
Prawo autorskie i pokrewne

1. Uczestnik przenosi prawa autorskie i pokrewne do rejestracji audio-video oraz sesji fotograficznych z jego udziałem, powstałych w ramach Masterclass 2024 w okresie od 01.07.2024 r. do 05.07.2024 r., do nieograniczonego w czasie, w kraju i za granicą, korzystania i rozporządzania, w całości lub we fragmentach, bez ograniczeń ilościowych (liczbowych), w tym udzielenia dalszych licencji w zakresie następujących pól eksploatacji:

• wprowadzanie artystycznego wykonania do pamięci komputera i sieci multimedialnych, w tym przechowywanie i dalsze przetwarzanie na dowolne formaty,
• publiczne wyświetlanie, odtwarzanie, wystawianie, wykonywanie, a także wszelkie inne wykorzystanie artystycznego wykonania lub jego fragmentów (lub jakichkolwiek jego elementów) w każdej formie eksploatacji, w dziełach wizualnych, audiowizualnych lub multimedialnych, dla potrzeb wszelkiego rodzaju reklam, pokazów reklamowych, konkursowych, festiwalowych, a także przeglądów i innych podobnych zdarzeń, w Internecie, prezentacjach multimedialnych, telewizji lub za pomocą wszelkich innych środków publicznego przekazu.
• Organizator zobowiązuje się do przekazania Uczestnikowi w formie elektronicznej nagrań, w których Uczestnik był głównym partycypantem (materiałów audio video, o których mowa w ust. 1).

2. Organizator udziela prawa do dysponowania przez Uczestnika nagraniami określonymi w ust. 1 tylko do użytku własnego (cele archiwalne) bez możliwości publicznego odtwarzania, lecz z możliwością prezentowania nagrań w:

• procesie rekrutacyjnym dot. konkursów artystycznych, kursów mistrzowskich (np. dyrygenckich);
• procesie rekrutacyjnym dot. pozyskania zatrudnienia (np. w celach przedstawienia portfolio).

3. Organizator nie udziela prawa do przenoszenia praw autorskich i pokrewnych w zakresie materiału artystycznego określonego w ust. 1 na osoby trzecie.

§ 6
Program Masterclass 2024

1. Program artystyczny Masterclass 2024 (w tym koncertu dnia 05.07.2024 r.):

• Gioacchino Rossini – Uwertura do opery Włoszka w Algierze
• Ludwig van Beethoven – I Symfonia C-dur op. 21
• Camille Saint-Saëns – I Koncert wiolonczelowy a-moll op. 33
• Wolfgang Amadeus Mozart – Symfonia nr 41 C-dur KV 551

2. Agenda Masterclass 2024

• Warsztaty dyrygenckie z Prowadzącym i orkiestrą symfoniczną
  01–04.07.2024, godz. 09.30–14.30
• 30 – 10.50 – warsztaty praktyczne cz. 1
• 50 – 11.20 – przerwa
• 20 – 12.40– warsztaty praktyczne cz. 2
• 40 – 13.10 – przerwa
• 10 – 14.30 – warsztaty praktyczne cz. 3
  – Konsultacje dyrygenckie. Konsultacje nagrań audio-video uczestników, zarejestrowanych podczas zajęć z Prowadzącym – analiza materiałów wykonawczych z warsztatów dyrygenckich.
  – 01-04.07.2024 r., godz. 17.00–19.00
  – Finał Masterclass 2024 – 05.07.2024 r.
• 30–13.00 – próba generalna do koncertu
• 00–19.00 – przerwa obiadowa i czas wolny
• 00–21.00 – koncert i oficjalne rozdanie certyfikatów

§ 7
Warunki rekrutacji

1. Rekrutacja składa się z trzech etapów.

• Pierwszy etap – nabór aplikacji w okresie od 07.03.2024 r. do 24.05.2024 r. (do godz. 23:59). Każdy z Aplikantów, w celu zakwalifikowania się do Masterclass 2024, jest zobowiązany do:
  1. wykazania doświadczenia w zakresie prowadzenia orkiestr symfonicznych;
  2. wykazania wykształcenia muzycznego lub statusu ucznia/studenta na kierunku muzycznym;
  3. znajdowania się w przedziale wiekowym od 18 lat (decyduje data dzienna, tj. Uczestnicy, którzy w dniu 24.05.2024 r. ukończyli 18. rok życia)
  4. posługiwania się językiem angielskim w mowie i piśmie na poziomie komunikatywnym.
• Każdy z Aplikantów, w celu zakwalifikowania się do Masterclass 2024, jest zobowiązany do dnia 24.05.2024 r. do:
  1. uzupełnienia formularza aplikacyjnego dostępnego pod adresem
  http://fitelbergcompetition.com/
  2. dołączenia do ww. formularza aplikacyjnego:
  – CV wraz z krótką biografią,
  – swojej fotografii portretowej lub podobnej (wymagania: 600 dpi, format TIF lub jpg),
  – skanu dokumentu potwierdzającego wykształcenie lub status ucznia/studenta;
  – linku (niewygasającego, bez limitów czasowych dostępności znajdujących się w odnośniku materiałów) odsyłającego do nagrania audio-video, przedstawiającego Aplikanta w roli dyrygenta (np. fragment próby lub koncertu z orkiestrą; do 3 do 10 minut, w formacie AVI lub MP4 )

2. Drugi etap – obrady zespołu rekrutacyjnego – 25.05–03.06.2024 r.

• Nadesłane przez Aplikantów zgłoszenia zostaną poddane analizie i ocenie przez zespół rekrutacyjny w składzie: Prowadzący oraz Dyrektor Filharmonii Ślaskiej im. Henryka Mikołaja Góreckiego.
• Nadesłane zgłoszenia będą oceniane pod względem formalnym (spełnienie wytycznych określonych w ust. 1) oraz artystycznym. Decyzja zespołu rekrutacyjnego jest ostateczna i nie przysługuje od niej środek odwoławczy.
• Lista końcowa będzie składać się z czterech kategorii:
  1. Uczestnicy czynni Masterclass 2024 (maks. 12 miejsc)
  2. Uczestnicy bierni Masterclass 2024 (maks. 12 miejsc)
  3. Lista rezerwowa – Uczestnicy czynni
  4. Lista rezerwowa – Uczestnicy bierni
• W przypadku zaistnienia sytuacji rezygnacji z kursu, określonych w §10 niniejszego Regulaminu, do uczestnictwa zapraszane są osoby będące następne w kolejności, wedle opublikowanej listy rezerwowej określonej w punkcie 2.3.

3. Trzeci etap – ogłoszenie wyników rekrutacji – 03.06.2024 r.

• Listy osób zakwalifikowanych do uczestnictwa (zarówno czynnego, jak i biernego) oraz listy rezerwowe zostaną ogłoszone na stronie Organizatora dnia 03.06.2024 r. (adres: http://fitelbergcompetition.com/).

§ 8
Proces post-rekrutacyjny

1. Osoby zakwalifikowane do uczestnictwa czynnego oraz biernego w III Międzynarodowym Kursie Dyrygenckim im. Grzegorza Fitelberga Masterclass 2024 zostaną poinformowane o wynikach rekrutacji indywidualnie drogą e-mailową przez Opiekuna Masterclass 2024 r. najpóźniej do dnia 05.06.2024 r.

2. Zakwalifikowane osoby, tj. Aplikanci, którzy uzyskają status Uczestnika (zarówno biernego, jak i czynnego) będą zobligowani do dokonania stosownych płatności określonych w § 9. Płatności należy dokonać najpóźniej do dnia 10.06.2024 r. Niedokonanie płatności w terminie jest równoznaczne z usunięciem Aplikanta z listy Uczestników.

§ 9
Dokonywanie opłat za uczestnictwo

2. Opłaty za uczestnictwo
Opłaty za uczestnictwo należy dokonywać w terminie od 03.06.2024 do 10.06.2024.

Dokonanie płatności po wyznaczonym terminie, tj. w dniu 11.06.2024 i później, będzie skutkowało skreśleniem z listy Uczestników III Międzynarodowego Kursu Dyrygenckiego im. Grzegorza Fitelberga Masterclass 2024.

• Wpłat można dokonywać w złotówkach (PLN) lub w euro (EUR), zgodnie z kursem bankowym z dnia przelewu (wg Narodowego Banku Polskiego), zgodnie z punktem 2.3. oraz 2.4.

§ 10
Warunki rezygnacji z Masterclass 2024

1. Każdy zakwalifikowany Uczestnik może zrezygnować z udziału w projekcie w terminie do 10.06.2024 r., składając e-mailowe oświadczanie o rezygnacji z III Międzynarodowego Kursu Dyrygenckiego im. Grzegorza Fitelberga Masterclass 2024 na adres: masterclass@fitelbergcompetition.com

2. W przypadku usunięcia Uczestnika z listy kwalifikacyjnej Masterclass 2024 określonej w § 7 ust. 3 Organizator może zakwalifikować do kursu Aplikantów z listy rezerwowej.
3. Rezygnacja z kursu Masterclass 2024 w okresie od 11.06.2024 r. do 30.06.2024 r. jest możliwa tylko z powodu tzw. siły wyższej, zgodnie z § 12 niniejszego Regulaminu.

§ 11
Lista rezerwowa

1. W sytuacjach określonych w § 10 ust. 2 oraz § 8 ust. 2 Organizator zastrzega sobie prawo do uzupełnienia listy kursantów zgodnie z listą kwalifikacyjną wskazaną w § 7 ust. 3.
2. Organizator ma przywilej skorzystania lub rezygnacji z prawa określonego w §11 ust. 1.
3. Aplikanci zakwalifikowani z listy rezerwowej i zaproszeni przez Organizatora do udziału w Masterclass 2024 po dniu 10.06.2024 r. mają czas na dokonanie formalności związanymi z uczestnictwem, określonych w § 9, w terminie do 7 dni robaczych od daty otrzymania zawiadomienia przez Organizatora.
4. Niedokonanie płatności w terminie określonym w §11 ust. 3 jest równoznaczne z usunięciem Aplikanta z listy Uczestników Masterclass 2024

§ 12
Siła wyższa

1. Termin „siła wyższa” oznacza zewnętrzne, niemożliwe do przewidzenia i zapobiegnięcia zdarzenie występujące i uniemożliwiające należyte wykonanie przez Organizatora lub Uczestnika jego obowiązków, w szczególności takie jak katastrofy naturalne, wojny, ataki terrorystyczne, strajki, choroba Prowadzącego Masterclass 2024.
2. Zarówno Organizator, jak i Uczestnik nie będą ponosić odpowiedzialności a niewykonanie lub nienależyte wykonanie swoich zobowiązań w ramach Masterclass 2024, jeżeli niewykonanie lub nienależyte wykonanie zobowiązań wynikających z Regulaminu III Międzynarodowego Kursu Dyrygenckiego im. Grzegorza Fitelberga Masterclass 2024 jest wynikiem działania siły wyższej.
3. Jeżeli zaistnieje okoliczność siły wyższej:
3.1. Organizator bezzwłocznie zawiadomi Uczestnika lub Uczestników o zaistnieniu siły wyższej i jej przyczynach drogą elektroniczną, wysyłając wiadomość na adres e-mail Uczestnika przekazany przez niego w formularzu aplikacyjnym, o którym mowa w § 7 niniejszego Regulaminu.
3.2. Uczestnik bezzwłocznie zawiadomi Organizatora o zaistnieniu siły wyższej i jej przyczynach drogą elektroniczną, wysyłając wiadomość na adres e-mail: masterclass@fitelbergcompetition.com .

1. Strona, której dotyczą okoliczności siły wyższej (Organizator lub Uczestnik) dołoży wszelkich starań, aby niezwłocznie, jednak nie dłużej niż w terminie do 2 dni od daty zawiadomienia, przedstawić drugiej Stronie uzasadnienie, które wyjaśnia naturę i przyczyny zaistniałej okoliczności siły wyższej w takim zakresie, w jakim jest to możliwe. Jeżeli po zawiadomieniu Strony nie uzgodnią inaczej, każda ze Stron będzie kontynuowała wysiłki w celu wywiązania się ze swoich zobowiązań.
2. W zakresie, w którym jedna ze Stron (Organizator lub Uczestnik) nie będzie mogła wykonać zobowiązań regulaminowych, wynikających z oddziałującej na nią siły wyższej, również druga Strona nie będzie odpowiedzialna za niewykonanie ww. zobowiązań.
3. W sytuacji, gdy okoliczności siły wyższej będą dotyczyć Uczestnika, a przekazane uzasadnienie zostanie zaakceptowane przez Organizatora, Uczestnik może uzyskać zwrot kosztów kursu, w całości lub części, w zależności od czasu wystąpienia okoliczności:
w okresie 11.06.2024 r. – 30.06.2024 r. – zwrot 100% kosztów kursu
w okresie 01.07.2024 r. – 05.07.2024 r. – zwrot 1 % kosztów kursu
4. W szczególnym przypadku zaistnienia siły wyższej po stronie Organizatora, jakim jest choroba lub inna nagła niedyspozycja Prowadzącego, Organizator zastrzega sobie w pierwszej kolejności prawo do zaproponowania adekwatnego zastępstwa za Prowadzącego Masterclass 2024.

§ 13
Zapobieganie, przeciwdziałanie i zwalczanie COVID-19

1. Uczestnik zobowiązuje się do samodzielnego zapoznania się i przestrzegania aktualnych, szczególnych ograniczeń i obostrzeń narzuconych na ternie Polski przez uprawnione organy publiczne, związanych z sytuacją stanu zagrożenia epidemiologicznego i stanu epidemii w związku z zakażeniami wirusem SARS-CoV-2 (COVID-19), w zakresie zapobiegania, przeciwdziałania i zwalczania wirusa.
2. W sytuacji niemożności wykonywania przez Uczestnika zobowiązań regulaminowych wynikających z przyczyn związanych z procedurami zapobiegania, przeciwdziałania i zwalczania COVID-19, określonymi w ust. 1, Organizator:

• nie będzie ponosił odpowiedzialności za niewykonanie swoich zobowiązań;
• nie będzie ponosił z tego tytułu żadnych konsekwencji finansowych;
• nie będzie dokonywał zwrotów kosztów Uczestnikowi z tytułu dokonanej przez niego opłaty za udział w III Międzynarodowym Kursie Dyrygenckim im. Grzegorza Fitelberga Masterclass 2024.

§ 14
Obowiązek informacyjny

1. Organizator realizuje obowiązek informacyjny w związku z wymaganiami art. 13 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych), zwany RODO.
2. Szczegółowe zapisy dot. RODO zostały zawarte w formularzu aplikacyjnym ( § 7 à 1.2. à a ).

§ 15
Postanowienia końcowe

1. Organizator zastrzega sobie prawo wprowadzenia zmian w niniejszym Regulaminie.
2. Powyższy Regulamin obowiązuje w okresie od 07.03.2024 r. do 06.07.2024 r.
3. Organizator zastrzega sobie prawo do odwołania III Międzynarodowego Kursu Dyrygenckiego im. Grzegorza Fitelberga w sytuacji, gdy liczba zakwalifikowanych Uczestników czynnych będzie mniejsza niż 8 osób.
4. W sprawach nieuregulowanych w Regulaminie stosuje się przepisy Kodeksu Prawa Cywilnego Rzeczypospolitej Polskiej.

Rules of the 3rd Grzegorz Fitelberg International Conducting Course Masterclass 2024

Terms and abbraviations

Grzegorz Fitelberg International Conducting Course – a paid conducting course held on 1-5 July 2024 by the Henryk Mikołaj Górecki Silesian Philharmonic, hereinafter referred to as Masterclass 2024.

Organiser – the Henryk Mikołaj Górecki Silesian Philharmonic with its registered office in Poland, Katowice, ul. Sokolska 2 (40-084), hereinafter referred to as the Organiser.

Instructor – a conductor, teacher, specialist transferring knowledge and experience, mastering practical skills of the Participants, hereinafter referred to as the Instructor.

Consultant – a specialist consulting audio-video recordings of the Participants registered during classes with the Instructor, hereinafter referred to as the Consultant.

Mentor – a person appointed by the Organiser to provide information on the course, to contact the Participants, and to build relations between the Participants and the Organiser, hereinafter referred to as the Mentor.

Applicant – each person who submits an application to participate in the 3^rd Grzegorz Fitelberg International Conducting Course, hereinafter referred to as the Applicant.

Participant – each person qualified to participate in the 3^rd Grzegorz Fitelberg International Conducting Course, hereinafter referred to as the Participant.  

§ 1
Introduction

These Rules define the terms and conditions of participation in the 3^rd Grzegorz Fitelberg Conducting Course Masterclass 2024 and principles of recruiting Course Participants.

§2
General Provisions

1. The objective of Masterclass 2023 is professionalisation of young conductors (aged from 18) through running a conducting course.
2. The workshops shall be held in Poland, in the Organiser’s headquarters, i.e.: the Henryk Mikołaj Górecki Silesian Philharmonic, on 1-5 July 2024.
3. The Participants will be educated in artistic and practical aspect.

• Artistic aspect – each Participant will have an opportunity to acquire conducting knowledge and skills – the conductor as the foundation of artistic expertise.
• Practical aspect – each Participant will have an opportunity to cooperate with the Symphony Orchestra of the Silesian Philharmonic – the conductor as the main performer of artistic activities.

1. Participation in Masterclass 2024 shall be possible for a fee, in compliance with § 9 of these Rules.

§ 3
Active Participation

1. The active participation in Masterclass 2024 is limited to 12 available places.
2. Within the scheme of the active participation, each of the 12 qualified Participants shall have:

• Accommodation for 6 nights (with breakfasts) in the vicinity of the Silesian Philharmonic,
• 4 days of practical workshops with the Instructor and the Symphony Orchestra of the Silesian Philharmonic,
• 4 days of audio-video recordings (registration of the conducting work performed by the Participant),
• 4 days of conducting consultations (analysis of the material recorded during the workshop session),
• Cooperation with the Symphony Orchestra of the Silesian Philharmonic, i.e.: work with the orchestra during 4 workshop sessions with the Instructor,
• An opportunity to conduct a part of a dress rehearsal to the concert on 5 July 2024,
• An opportunity to perform in front of an audience and to conduct the Symphony Orchestra of the Silesian Philharmonic during a part of the concert on 5 July 2024,
• A course completion certificate.

3. The work performed during the Masterclass 2024 comprises three items.
   • The work with the Instructor (item one).

The first stage covers workshop sessions, during which Participants will work with the Symphony Orchestra of the Silesian Philharmonic. Each conducting activation run by the Instructor will comprise working on an actual performance material directly with the Participant. Passive participants will be simultaneously studying the art of conducting through observation. The order of conducting activation of the Participants will be alphabetic (from A to Z), and its minimum duration shall be 20 minutes each day from 1 to 5 July 2024, for each active Participant.

• Conducting consultations (item two).

The classes shall cover an analysis of the material recorded during the workshop session. The classes will be held for the entire group, and the Consultant will point to areas for development to each active Participant. The recorded material shall be also made available to active Participants of the masterclass in a form recorded exclusively for their archival use (in compliance with § 5 of these Rules). The person of the Consultant does not have to be the same as the person of the Instructor.

• Masterclass Finale (item three).

Performance with the symphony orchestra in front of the audience, presenting the performance material which was the topic of the workshop classes Masterclass 2024 (dress rehearsal + concert).

4. Furthermore, the Instructor, based on specific practical reasons, will select one Masterclass 2024 Participant, who will be automatically qualified to the 12^th Grzegorz Fitelberg International Competition for Conductors The Participants will be qualified to the 12th Grzegorz Fitelberg International Competition for Conductors 2028 regardless of the Participant’s age. The Instructor’s decision will not be justified, will be final, and shall not be subject to appeal.

§ 4 Passive Participation

1. The passive participation in Masterclass 2024 is limited to 12 available places.
2. Within the scheme of the passive participation, each of the 12 qualified Participants shall have:

• The right of passive observation of cooperation between the Instructor and the active Participants on conducting the Symphony Orchestra of the Silesian Philharmonic during:

1. 4 workshop sessions with the Instructor,
2. The dress rehearsal to the concert on 5 July 2024,
3. The concert on 5 July 2024.
   • A course completion certificate.

3. Passive Participants shall be obliged to organise and finance accommodation on their own.

§ 5
Copyright and Related Rights

1. The Participant transfers the copyright and related rights to the audio-video recordings and photo shoots with the Participant, prepared within the scheme of Masterclass 2024 from 1 July 2024 to 5 July 2024, to the unlimited in time, in Poland and abroad, use and distribution, in whole or in parts, with no limitations as to quantities (numbers), including granting sublicenses in the scope of the following fields of exploitation:

• Saving the artistic performance in computer memory and multimedia networks, including storage and further processing into any formats,
• Public display, playing, staging, performing, as well as using in any other way the artistic performance or parts thereof (or any of its elements) in any form of exploitation, in visual works, audio-visual works, or multimedia works, for the purposes of all sorts of advertising, advertising shows, competition shows, festival shows, as well as reviews and other similar events, on the Internet, in multimedia presentations, on television, or by means of any other means of public communication.
• The Organiser commits to provide the Participant with recordings – in the electronic form – featuring the Participant as the main character (the audio-video materials referred to in section 1).

2. The Organiser grants the right for the Participant to dispose of the recordings referred to in section 1 exclusively for personal use (archival purposes) with no right to display them in public, but with the right to present the recordings in:
   • Recruitment procedures of artistic competitions, masterclasses (e.g.: in conducting);
   • Employment recruitment procedures (e.g.: for the purposes of portfolio presentation).
3. The Organiser does not grant the right to transfer copyright and related rights to the artistic material referred to in section 1 onto any third parties.

§ 6

§ 7
Recruitment Terms

1. The recruitment process consists of three stages.
2. First stage – call for applications – applications are to be submitted from 7 March 2024 to 24 May 2024 (by 11:59 p.m.). Each Applicant wishing to qualify to Masterclass 2024 is obliged to:

1. Demonstrate their experience in conducting symphony orchestras;
2. Prove their degree in music or their status of a student of music;
3. From 18 years of age (i.e.: on 25 May 2024 they must be after their 18^th birthday);
4. Be communicative in English in speech and writing.

• In order to qualify to Masterclass 2024, each Applicant is obliged to satisfy the following conditions by 24 May 2024:
  1. Complete the application form available on
     https://fitelbergcompetition.com/
  2. Attach the following to the application form:
     • A CV with a short biography,
     • A portrait or equivalent photograph (requirements: 600 dpi,
       TIF lor jpg),
     • A scan of a document confirming the Applicant’s degree or status of a student or music;
     • A link (non-expiring, with no time limitation as to the availability of its contents) allowing to access an audio-video recording featuring the Applicant in the role of a conductor (e.g.: a part of a rehearsal or concert with an orchestra, 3 to 10 minutes, in AVI or MP4 files),
  3. Second stage – deliberations of the recruitment team – from 25 May 2024 to 3 June 2024.
     • The applications submitted by Applicants will be analysed and evaluated by a recruitment team consisting of the Instructor and the Director of the Henryk Mikołaj Górecki Silesian Philharmonic.
     • The submitted applications shall be verified in terms of their formal compliance (satisfying the guidelines defined in section 1) and artistic level. The decision of the recruitment team shall be final and not subject to appeal.
     • The final list will consist of the following four categories:
       1. Active Participants of Masterclass 2024 (max. 12)
       2. Passive Participants of Masterclass 2024 (max. 12)
       3. Reserve list – active Participants
       4. Reserve list – passive Participants
     • In the event of a resignation from the course as provided for in § 10 of these Rules, the next persons from the list will be invited, according to the order featured on the published reserve list referred to in item 2.3.
  4. Third stage – announcement of recruitment results – 3 June 2024.
     • Lists of persons qualified to Masterclass 2023 (as active or passive Participants) and reserve lists shall be published on the Organiser’s website on 3 June 2024 (address: https://fitelbergcompetition.com/).

§ 8 Post-Recruitment Process

1. Persons qualified to the 3^rd Grzegorz Fitelberg International Conducting Course as active and passive Participants shall be informed on recruitment results individually via e-mail by the Mentor of Masterclass 2024 by 5 June 2024 at the latest.
2. Qualified persons, i.e.: Applicants who will be granted the status of the Participant (active or passive) will be obliged to remit the payments defined in § 9. The payments shall be remitted not later than by 10 June 2024. Failure to remit payments within the stipulated time limit shall be equivalent with deleting the Applicant from the list of Participants.

§ 9
Payments for Participation

2. Participation fees
   • Participation fees shall be paid from 3 June 2024 to 10 June 2024.

Remitting the payment after the stipulated time limit, i.e.: on 11 June 2024 and later, shall result in deleting a given person from the list of Participants in the 3^rd Grzegorz Fitelberg International Conducting Course Masterclass 2024.

• Payments shall be made in PLN or EUR, according to the exchange rate as of the date of the wire transfer (as quoted by the National Bank of Poland), in compliance with items 2.3 and 2.4 § 9.

§ 10
Terms of Resignation from Masterclass 2024

1. Each qualified Participant can resign from participation in the project by  10 June 2024, by submitting an e-mail statement on resignation from the 3^rd Grzegorz Fitelberg International Conducting Course Masterclass 2024 to the address: masterclass@fitelbergcompetition.com
2. Should any Participant be deleted from the Masterclass 2024 qualification list referred to in § 7 section 3, the Organiser can qualify Applicants from the reserve list to participate in the course.
3. Resignation from Masterclass 2024 in the period 11 June 2024 – 30 June 2024 shall be possible exclusively due to force majeure, in compliance with § 12 of these Rules.

§11
Reserve List

1. In situations referred to in § 10 section 2 and § 8 section 2 the Organiser reserves the right to add to the list of course participants in compliance with the qualification list referred to in § 7 section 3.
2. The Organiser shall have the privilege to exercise or waive the right referred to in §11 section 1 at its discretion.
3. Applicants qualified from the reserve list and invited by the Organiser to participate in Masterclass 2024 after 10 June 2024 will be obliged to satisfy all the formal requirements relating to their participation referred to in § 9 within 7 business days after the date of receipt of the notice from the Organiser.
4. Failure to pay the fee within the time limit defined in §11 section 3 shall be equivalent with deleting the Applicant from the list of Participants of Masterclass 2024.

§ 12
Force Majeure

1. The term “force majeure” means an external unpredictable and unpreventable event the occurrence of which prevents the Organiser or the Participant from fulfilling their obligations, in particular such as natural disasters, wars, terrorist attacks, strikes, illness of the Masterclass 2024 Instructor.
2. The Organiser and the Participant shall not be held liable for failure to perform or inappropriate performance of their obligations relating to Masterclass 2024 if the failure to perform or inappropriate performance of their obligations relating to the Rules of the 3^rd Grzegorz Fitelberg International Conducting Course Masterclass 2024 results from force majeure.
3. In the event of force  majeure:

3.1.      The Organiser shall immediately notify the Participant or Participants on the occurrence of force majeure and causes thereof electronically by sending an e-mail message to the Participant’s address provided in the application form referred to in § 7 of these Rules.

3.2.      The Participant shall immediately notify the Organiser on the occurrence of force majeure and causes thereof electronically by sending an e-mail message to masterclass@fitelbergcompetition.com .

1. The Party affected by force majeure (Organiser or Participant) shall make every effort to immediately and in any case not later than within 2 days after the date of notice provide the other Party with a reasonable justification explaining the nature and causes of the force majeure occurrence. If after the notice the Parties do not agree otherwise, each of the Parties shall continue their best efforts in order to meet their obligations.
2. To the extent that one of the Parties (Organiser or Participant) is not able to meet their obligations resulting from these Rules due to being affected by force majeure, the other Party shall not be held liable for failure to perform the aforementioned obligations.
3. If force majeure affects a Participant and their justification is accepted by the Organiser, the Participant will be able to get a refund of the course fee, fully or partially, depending on the time of force majeure occurrence:

1. 11 June 2024 – 30 June 2024 – full refund of the course fee
2. 1 July 2024 – 5 July 2024 – refund of 1% of the course fee

1. In a special case of force majeure affecting the Organiser, such as the Instructor’s illness or any other sudden indisposition, the Organiser reserves the right to first of all propose an adequate substitution for the Masterclass 2024 Instructor.

§ 13
Preventing, Counteracting, and Combating COVID-19

1. The Participant commits to follow and comply with the current special limitations and restrictions imposed in Poland by competent public authorities in relation to the state of epidemic threat and the state of epidemic caused by SARS-CoV-2 (COVID-19) in terms of preventing, counteracting, and combating the virus.
2. If the Participant is not able to fulfil their obligations under these Rules for reasons attributed to procedures of preventing, counteracting, and combating COVID-19 referred to in section 1, the Organiser:

• Shall not be held liable for failure to fulfil their obligations;
• Shall not suffer any financial consequences for this reason;
• Shall not reimburse the Participant for the payment of the participation fee in the 3^rd Grzegorz Fitelberg International Conducting Course Masterclass 2024.

§ 14
Obligation to Provide Information

1. The Organiser fulfils the obligation to provide information under the provisions of Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), referred to a s GDPR.
2. Detailed requirements relating to GDPR are set forth in the application form (§ 7  à 1.2. à a ).

§ 15
Final Provisions

1. The Organiser reserves the right to amend these Rules.
2. These Rules shall come into force on 7 March 2024 and will remain binding until  6 July 2024.
3. The Organiser reserves the right to cancel the 3^rd Grzegorz Fitelberg International Conducting Course if the number of qualified Participants is lower than 8.
4. All matters not regulated herein shall be governed by relevant provisions of the Civil Code of the Republic of Poland.
